Terms & Conditions

1. Who we are

Fruta Passport is operated by Kevork Wakimian ("we", "us", the "Seller"). By creating an account or using the service, you enter into a contract with the Seller.

2. Acceptance of these terms

By accessing or continuing to use Fruta Passport, you agree to these Terms & Conditions. If you do not agree, please do not use the service. You must be of legal age in your jurisdiction, or have authority to bind the organization you represent.

3. The service

Fruta Passport is a fruit-exploration travel companion: country fruit packs, tasting journals, photo storage, AI fruit identification, market guides, and printable passport keepsakes. The Thailand pack is free; other country packs and the World Pass are one-time purchases.

4. Payments, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) and Paddle's Refund Policy (https://www.paddle.com/legal/refund-policy), in addition to our own Refund Policy. Purchases are one-time; there are no subscriptions or recurring charges.

5. Acceptable use

You must not misuse the service. This includes: unlawful use; fraud or spam; infringing intellectual property rights; interfering with security (including introducing malware, probing or scanning systems, or scraping the service); attempting to circumvent technical limits such as pack locks or scan quotas; and reselling or redistributing the service or its content.

6. AI identification

AI fruit identification and comparison outputs may be inaccurate. They are provided for curiosity and education only and must not be relied upon to decide whether a food is safe to eat. Never eat anything based solely on an AI identification. You are responsible for the photos you upload and for how you use the outputs.

7. Your account and content

You must keep your account credentials confidential and are responsible for activity under your account. You must provide accurate information and keep it up to date.

You retain ownership of the photos and journal entries you create. You grant us a limited license to host and process that content solely to provide the service to you.

8. Intellectual property

We retain all ownership of the service and its intellectual property, including software, fruit catalogs, guides, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within the packs you have access to. You may not reverse engineer the service except where permitted by law.

9. Service level and warranties

We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months before the claim, and we exclude liability for indirect, consequential or special damages (including loss of profits, data or goodwill). Nothing in these terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.

11. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may delete your account at any time from the account window in the app; deletion removes your journal, photos and purchase records.

12. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for delays caused by events beyond our reasonable control. These terms are governed by the laws of the Seller's jurisdiction, and disputes will be resolved in its courts unless mandatory consumer law provides otherwise.
